
A real estate agent who acts on behalf of a Buyer has a
fiduciary duty of loyalty to the Buyer. In practical terms, that
means the Buyer's agent is concerned with the Buyer's best interests
in the transaction, and the agent should attempt to obtain for
the Buyer the most favorable purchase price and terms. As a Buyer's
agent, the agent is not the Seller's agent, even if by agreement
the agent may receive a commission from the Seller. A Buyer's
agent has affirmative fiduciary obligations and duties (to the
Buyer) of loyalty, obedience, disclosure, confidentiality, reasonable
care and accounting in dealings with the Buyer. A Buyer's agent
